As of January 1, 2013 these terms are no longer used in Arizona, They have been replaced by "legal decision making" and "parenting time". As the years go by, both the legislature and the courts are recognizing that fathers are just as well equipped to care for their children as mothers are. Conciliation Court, an arm of the Superior Court, is available, free of charge, to mediate these issues. Absent an emergency, the Pima County Superior Court requires such mediation prior to the filing for the Court's intervention. An example of the work I have done is this area can be seen in Mancusi and Mancusi, 519 N.Y.S.2d (Family Court, Westchester County 1987). At issue was which court, the one in New York or the one in Arizona, should decide issues regarding the parties' children.
