An appeal is a legal action which asks a higher Court to change the ruling of a lower Court. Appeals from City Court and Justice Court go to the Superior Court. Appeals from the Superior Court go to the State Court of Appeals. Appeals from the Court of Appeals go to the State Supreme Court and from there, where permitted, into the Federal Court system. Appeals take place in both criminal and civil cases. There are very particular rules governing appeals. It is imperative that the appropriate time limits are complied with for the filing of the Notice of Appeal. Less than 10% of all appeals are successful. I suggest that a non lawyer has virtually no chance of being successful handling his or her own appeal. State v. Mena, set forth in the "Cases" section of my web site, is an appeal which I handled.
